Terms of Service
These terms are the agreement between you and Dignity. They cover what Dignity is, what it is not, what we each expect of the other, and what happens if something goes wrong. Please read section 3 carefully — it is the one people most often assume the opposite of.
1. Who we are
Dignity is an emotional-wellness application operated by Dignity Inc App, a corporation incorporated in Texas ("Dignity", "we", "us"), with its principal place of business at 3603 Vineyard Way, Farmers Branch, TX 75234, United States. You can reach us at app@dignity-inc.com.
2. Who may use Dignity
You must be at least 18 years old to create an account on your own behalf.
If you are between 13 and 17, you may use Dignity only if a parent or legal guardian has read these terms and accepted them on your behalf. By creating an account in that age range you confirm that they have.
Dignity is not available to anyone under 13. We ask for a date of birth when you create an account and we do not knowingly permit accounts for children under 13. If we learn that we have one, we close it and delete the information.
3. What Dignity is, and what it is not
Dignity is a tool for emotional-wellness coaching and self-reflection. It helps you notice, name and navigate what you are feeling, using the Emotions-Centered Coaching™ method.
Dignity is not therapy. It is not medical care, mental-health treatment, or a diagnosis, and it is not a substitute for care from a licensed professional. The coach inside Dignity is an artificial intelligence, not a person and not a clinician. Its replies are generated by a machine-learning model and can be wrong.
Nothing in Dignity creates a doctor-patient, therapist-client, or other professional relationship between you and us. If you are being treated by a professional, Dignity is not a reason to change or stop that treatment.
4. Emergencies and crisis situations
Dignity does not provide emergency services and no one at Dignity monitors your conversations in real time. Sending a message to the coach does not alert a human being.
If you or someone else is in immediate danger, call 911 or your local emergency number. If you are in crisis, call or text 988 (the Suicide & Crisis Lifeline in the US). Our crisis support page lists these and other free, confidential lines, and describes how the coach is instructed to respond when someone is struggling.
5. Your account and your information
You are responsible for keeping your password confidential and for activity that happens under your account. Tell us promptly if you believe someone else has access to it.
What you write in Dignity — the emotions you name, your journal entries, your reflections and your coach conversations — is consumer health information, and we treat it that way. How we collect, use, store and delete it is described in our Privacy Policy, which forms part of these terms, together with our Consumer Health Data Privacy Policy. Before your first check-in we ask you to acknowledge that Dignity stores this information, and we collect it only after you do.
You can download everything you have written, or permanently delete your account and its contents, at any time from Profile in the app.
6. Organization and school seats
If your access to Dignity is paid for by an employer, school, or another organization, that organization is our customer and its agreement with us also applies to that access.
Your organization cannot read what you write. It does not see your check-ins, journal entries, reflections or coach conversations. It receives only aggregate, anonymized reporting about its group as a whole, and only where the group is large enough that individuals cannot be identified from it.
If your organization stops paying for your seat, your individual access may end. Your own entries remain yours and you can export them before that happens.
Where a school or district deploys Dignity to students, the school is responsible for obtaining any parental consent that applies under COPPA, FERPA or state student-privacy law.
7. Acceptable use
Use Dignity for its purpose, and not to harm anyone. Specifically, you agree not to:
- Use Dignity to threaten, harass, abuse, or harm another person.
- Attempt to make the coach produce content that is illegal, or that is intended to hurt someone.
- Share your account with someone else, or create an account for someone who is not permitted to have one.
- Scrape, crawl, bulk-download, or systematically extract content from Dignity.
- Reverse engineer, decompile, or attempt to derive the source code or the underlying prompts and models, except where that restriction is not permitted by law.
- Probe, scan, overload, or interfere with the service or the systems it runs on, or bypass any limit, gate, or authentication.
- Resell, sublicense, or provide Dignity to others as a service.
We may suspend or close an account that breaks these rules, and where the conduct is serious we may do so without notice.
8. Subscriptions and billing
Some parts of Dignity require a paid plan. Prices and what each plan includes are shown in the app before you buy.
Payments are processed by Stripe, Inc. We do not receive or store your full card details.
Paid plans renew automatically for the same period until you cancel. You can cancel at any time, and cancellation takes effect at the end of the period you have already paid for. We do not refund partial periods except where the law requires it.
If we change the price of a plan, we will tell you before the change applies to you, and you may cancel rather than accept it.
9. Intellectual property
Dignity, its content, its software, and the Emotions-Centered Coaching™ and The Answers Within™ methods and marks belong to us or our licensors. These terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own emotional wellbeing, and nothing more.
What you write stays yours. You keep ownership of your check-ins, journal entries and reflections. You grant us only the permission we need to operate the service for you: to store your content, display it back to you, and send your coach messages to our AI provider in order to generate a reply. We do not sell your content and it is not used to train any AI model.
10. Disclaimer of warranties
Dignity is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that Dignity will be uninterrupted, error-free, or secure against every threat, that the coach's replies will be accurate, appropriate, or suitable for your situation, or that using Dignity will produce any particular outcome for your wellbeing.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Dignity and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, service interruption, or computer damage arising out of or relating to your use of Dignity.
Unless such limits are prohibited by applicable law, Dignity’s total liability for all claims arising out of or relating to Dignity is limited to the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars ($100.00 USD) if you paid us nothing.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Dispute resolution and arbitration
PLEASE READ THIS SECTION CAREFULLY BECAUSE, UNLESS YOU OPT OUT, IT REQUIRES YOU AND DIGNITY TO ARBITRATE CERTAIN DISPUTES AND CLAIMS AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM DIGNITY, INCLUDING A LIMITATION ON THE RIGHT TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM.
Most concerns can be resolved quickly. Before starting a formal proceeding, you agree to provide us written notice of any dispute, claim, or controversy arising out of or relating to Dignity at app@dignity-inc.com and give us thirty (30) days to resolve it with you. Your written notice must (i) include your name, residence address, email address, and telephone number; (ii) describe the nature and basis of the dispute; and (iii) set forth the specific relief sought.
If you and Dignity cannot timely reach an agreement to resolve said dispute, you and Dignity agree that any dispute arising out of or relating to these terms or to Dignity will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may still bring an individual claim in small-claims court.
You and Dignity each waive the right to a jury trial and the right to participate in a class action or class arbitration.
You may opt out of this arbitration agreement by emailing app@dignity-inc.com within thirty (30) days of first accepting these terms, saying that you opt out and giving the email address on your account. Opting out does not affect anything else in these terms.
13. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Where a dispute is not subject to arbitration, the state and federal courts located in Dallas County, Texas have exclusive jurisdiction, and you consent to that jurisdiction.
14. Ending your account, and changes to these terms
You can stop using Dignity at any time and delete your account from Profile in the app. We may suspend or end your access if you break these terms, if we are required to by law, or if we discontinue the service. If we discontinue it, we will give you reasonable notice and a way to export what you have written.
We may update these terms. If a change is significant, we will raise the version of these terms and ask you to accept the new version in the app before you continue. Continuing to use Dignity after a change means you accept the updated terms.
Sections that by their nature should survive the end of your account do survive it, including sections 9, 10 and 11.
